1. Agreement to Terms: By subscribing to our services, you automatically agree to adhere to the Terms and Conditions set forth by S Gallery. It’s important to review these terms carefully before committing to our subscription.
2. Rights to Use Artistic Content: As a subscriber, you grant S Gallery the right to use, post, edit, and list any photos, videos, or documents you provide related to your artwork. This includes the use of your content on various platforms and promotional materials to enhance your visibility and sales potential.
3. Content Authorization: You authorize us to edit and adjust the provided images and descriptions to fit the format and style of various marketing platforms, including Artsy and related auction houses.
4. Intellectual Property: While you retain ownership of all original artworks, by subscribing, you allow S Gallery to use the digital representations of your art for marketing and sales purposes across all platforms and media.

Copyright and Use of Material
All content, including images, text, and artwork descriptions, are owned by S Gallery LLC or used with permission from the artists. You may not reproduce, duplicate, copy, sell, redistribute, or exploit any material on the website for commercial purposes without obtaining express written consent from us. 2. Intellectual Property
The artworks, images, and texts featured on our website are either the property of S Gallery LLC or are used with explicit permission from the artists. Unauthorized use of this material may give rise to a claim for damages and/or be a criminal offense.
3.Purchases and Payment Terms
Subscription and Sales Commission
Subscription Fee: The monthly subscription fee for S Gallery is specified in the pdf document you receive after we accept your application . This fee grants access to our platform, personal website setup, and exclusive artist services.
Sales Commission: In addition to the monthly subscription, S Gallery charges a 10% commission on any sales made through Artsy or auction houses. This is to cover the facilitation and handling involved in these platforms.
Pricing on Artsy: The listed price of artwork on Artsy includes the base price set by the artist plus:
A 10% commission for S Gallery
A 5% commission for Artsy
Applicable VAT (Value Added Tax)
Auction House Sales: Auction houses also charge a fee on artworks sold through their platforms. This fee varies by platform and will be already calculated into the set reserve price (lowest selling price)
Shipping Responsibilities: The artist is responsible for packaging and shipping the artwork, ensuring that all costs related to shipping are covered by the buyer and added to the payout amount (if not provided by the artist we will provide the erstimated shipping prices and adjust the listing prices accordingly). It is also the artist’s responsibility to insure the artwork. In the event of damage or loss during shipping, the artist must provide solutions to the buyer, which could include cancelling the sale, offering a discount to cover repair costs, or proposing an alternative artwork. S-Gallery will act as an intermediary in these situations, facilitating communication and resolution between the artist and buyer. In case of white glove shipments made through artsy, packaging insurance and shipment price will automatically be taken care off.
Subscription Cancellation: S Gallery reserves the right to cancel the artist’s subscription and remove them as a represented artist at any time without having to provide a reason.
Payouts
When an artwork sells, the timing of payouts varies by platform. Some platforms disburse funds immediately, while others may take up to three business days. We will notify you as soon as your artwork is sold create an invoice for the agreed-upon sales price. For auctions for the highest bid after all fees have been deducted. Once we receive the funds from the sales platform, we ensure they are transferred to you within 1-2 business days.

The information on this website is provided “as is,” and we make no representations or warranties, express or implied, about the completeness, accuracy, reliability, suitability, or availability of the website’s content. We will not be liable for any loss or damage arising from the use of our website.
